India’s E-Invoice Rollout Has Passed: A Freelancer’s GST Guide

Threshold descriptions differ, and a mandated invoice needs IRP registration before a buyer can claim input tax credit.

The Government set India’s e-invoice implementation for 01 October 2020, and that date has passed; freelancers should check whether their turnover puts them in scope before issuing GST invoices.

Check whether the turnover rule applies to you

The threshold descriptions do not line up. A Finance Ministry notification said businesses with turnover of ₹5 crore or more would adopt e-invoicing from August 1. Another description said businesses with ₹10 crore and above had to generate e-invoices for all B2B transactions. A third put coverage above ₹5 crore and said businesses above ₹10 crore had to report invoices within 30 days of issue. The mandate described under Rule 48(4) applies to a notified class of registered persons, so do not assume every freelancer is covered.¹²³⁴

A further reduction of the threshold to ₹1 crore was described as a government plan for the future, not as an effective rule with a stated start date. Do not treat that proposed figure as the test for an invoice you are issuing now. The practical decision is whether your business falls within the turnover band and notified class described in the applicable statements. The material does not establish that every creator or freelancer meets those conditions.¹²³⁴

Put the required details on your tax invoice

Rule 46 of the CGST Rules lists the details a tax invoice must carry. Treat that as the reference point when preparing a GST invoice, rather than assuming a payment request alone meets the tax-invoice requirements. The available information does not enumerate every detail under the rule, so do not fill in an invented checklist. Use the rule’s invoice requirements as the basis for checking the document you send to a client.¹²³⁴

The stated numbering requirement is specific: a GST invoice needs a unique, sequential invoice number of up to 16 characters for the financial year. Make that number part of your invoice process and check that it meets both the sequence and length conditions. This is a concrete requirement you can verify on each invoice; the information here does not support adding extra numbering rules or a separate document requirement.¹²⁴

Register invoices when the mandate applies

For the notified class of registered persons, Rule 48(4) describes the e-invoice step: upload specified invoice particulars in FORM GST INV-01 to the Invoice Registration Portal, or IRP, and obtain an Invoice Reference Number, or IRN. The uploaded data is registered on the IRP and generates that unique number. If the rule covers your business, build this registration into how you issue the invoice rather than treating portal registration as an optional afterthought.¹²³⁴

An invoice that is not registered on the portal is described as invalid. The stated consequence is that its recipient cannot claim input tax credit on it, and applicable penalties can also follow. That creates a direct risk for a freelancer billing a business client: an invoice sent without required registration may fail as a tax invoice and leave the client unable to claim the credit. Confirm that the IRP step is complete when the mandate applies.¹²³⁴

The penalty is described in two ways: as a minimum amount under the laws, and as an amount charged for each instance of non-compliance. Both descriptions give ₹10,000, with the minimum account also noting a further amount proportionate to tax evaded. Treat a missed registration as a compliance and cost risk, not merely a formatting error. The stated penalty is a reason to check invoice registration before relying on the document.¹³

For freelance work billed to a business, a valid invoice therefore affects the client’s credit as well as your own compliance.¹²³

Protect the client’s credit and check goods-related rules

Mahesh Jaising, Partner, Leader (Indirect Tax) with Deloitte India, said compliant supplier e-invoicing supports the proper flow of input tax credit and reduces credit-related churn. Vivek Jalan, Partner with Tax Connect Advisory, said a B2B customer accepting a non-compliant invoice could lose input tax credit, generally creating a GST loss of 18 per cent. For freelance work billed to a business, a valid invoice therefore affects the client’s credit as well as your own compliance.¹²³

The Invoice Management System gives buyers a step before an invoice reaches GSTR-2B: they can accept or reject each supplier invoice. That means a client has a stated mechanism for reviewing supplier invoices, so do not assume that sending an invoice guarantees it will pass through the buyer’s process unchanged. Make the invoice’s required registration and details part of the delivery you check, especially when the customer is a business.¹²³

If your creator work includes transporting goods, a valid tax invoice has a further stated consequence: transporting goods without one may lead to detention of the goods and vehicle and a penalty. The Government also planned a check that would restrict e-way bill generation without an IRN. That check was described as a plan, so treat it as a stated risk direction rather than claiming it is already in force.¹³

Choose an invoice route that matches your turnover band

The API eligibility information uses separate turnover bands. Businesses with GST aggregate turnover above ₹500 crore were described as required to comply with e-invoicing, and taxpayers in that band were eligible to use APIs from the implementation date noted earlier. Taxpayers between INR 100-500 Crore became eligible from 1 January 2021; those with turnover up to INR 50 Crore became eligible from 1 April 2021. These are eligibility statements, not evidence that every freelancer needs an API.¹²³⁴

Businesses obtain e-invoicing APIs from government-appointed GST Suvidha Providers, or GSPs, or use e-invoicing software. If your turnover band makes API use relevant, those are the two routes stated here; the information does not specify their prices or rank one as better. Career Ahead’s recommendation is to settle the coverage question first, then use the applicable route to register mandated invoices and check the invoice number before billing a client.¹²³⁴
